The GTC apply to all services provided by riAuto Hauri and become valid upon conclusion of a contract (point 2). Deviating regulations on the part of the contracting party have therefore no validity. By sending an order to riAuto Hauri, the customer confirms to have read the present GTC and agrees with them.
Sales contracts come off by acceptance of the order by riAuto Hauri. The acceptance of the order is confirmed to the customer via e-mail and is subsequently binding for the customer. Delivery obstacles are likewise communicated to the customer as fast as possible by E-Mail. With his order, the customer confirms that he is aware of the scope and content of his order. Questions in this connection can therefore be clarified in advance with us.
The delivery of the goods is basically made by the post office. If an article of our assortment should not be available exceptionally, then this is communicated to the customer as fast as possible by E-Mail.
4. order by invoice
If an order is made by invoice, it must be paid in full within 14 days. In the case of a return we issue a credit note. In case of late payment, the following reminder fees will be charged: 1st reminder CHF 10.00, 2nd reminder CHF 30.00, summons for payment CHF 90.00.
5. collection in Küssnacht am Rigi
We also offer the customer the possibility, after consultation, to pick up his order directly in our warehouse in Küssnacht am Rigi. For this purpose, we offer the option "Do not ship" in the checkout process. Of course, there are no shipping costs for the customer.
6. price information
In principle, we try to offer our customers the products at the best possible price, but this is closely linked to the prices of our suppliers. The company riAuto Hauri has therefore expressly the right to adjust the prices indicated online without notice and without further explanation. For the order and delivery, the principle applies that in the calculation of prices, the time of the order on the website is valid.
A right to return the ordered goods exists in principle only in the case of wrong delivery by riAuto Hauri, production defects, transport damage which occurred in the course of delivery. We therefore expressly ask our customers to check the received delivery promptly upon receipt for corresponding defects. Any defects or deficiencies in the delivery must be reported to riAuto Hauri immediately. If there is a defect or damage for which riAuto Hauri is responsible, riAuto Hauri is entitled to decide at its own discretion between exchange or remedy of defects. The goods must be returned in their original packaging, unused and complete.
In case of wrong delivery, riAuto Hauri agrees to send the customer the correct item(s), if possible, or otherwise settle the order via an appropriate replacement (at the customer's choice) with the same value of goods. Cancellation of the order is not possible as long as the ordered item is available.
Defective or damaged articles are always examined by us for the corresponding defects, in order to ensure the warranty claim. Damages which are based on faulty material or on errors in the production, are treated by riAuto Hauri analogously to the regulations with wrong delivery. In principle, a dissolution of the contractual relationship in the above incidents will not be granted.
In the case of transport damage, a report with detailed information about the damage by e-mail is required within 48 hours after receipt of the goods, otherwise the right to free replacement expires. In the case of incorrect return, any costs incurred in the course of the return of riAuto Hauri will be charged to the customer. The customer is granted a period of 5 working days from receipt of the goods, within which the goods can be returned to riAuto Hauri together with the notice of defects. The procedure for returns must be observed. Please note that a return will never result in a payment as long as the ordered goods are available. We reserve the right to compensate you for the corresponding value of the goods with a voucher or an equivalent item.
The shipping costs are always to be paid by the customer. Not sufficiently stamped returns can unfortunately not be processed. The shipping costs will be refunded to the customer only if the delivery is a misdelivery, from riAuto Hauri or production damage or transport damage. Articles excluded from exchange
For the warranty period we refer to the General Terms and Conditions of the respective manufacturer, which are binding. If it is determined that the parts have not been installed and put into operation by a licensed workshop, the manufacturer and supplier may reject any warranty claims. We do not accept any liability for consequential damages and expenses incurred due to malfunction of our parts. No warranty is given for parts from old stock and used parts, unless it is stated in the product description.
9. model deviations
It happens that our suppliers slightly modify the design of individual items. We cannot accept any liability for such modifications, as we have no influence on them. However, you have the right to exchange such items.
riAuto Hauri does not assume any liability for misconduct of the customer in the care and/or handling of the delivered articles. We therefore ask the customer to observe the relevant instructions.
11. liability in general
We hereby expressly point out that riAuto Hauri excludes any liability claims. This applies, among other things, for accidents, etc. which are due to the handling of hardware (conversion of vehicles, etc.) and consequential damages due to manufacturing defects in parts. The customer has to ensure that the received parts are intended for installation on his object. When handling the mentioned items, the customer is kindly requested to follow the corresponding legal regulations.
12. reservation of proprietary rights
Up to the complete payment the supplied commodity remains property of riAuto Hauri.
13. change AGB
It should be noted at this point that riAuto Hauri reserves the right to change these terms and conditions at any time in the interest of the company without prior notice. In case of a concluded contract, the version of the GTC at the time of the order is valid.
14. Applicable law/place of jurisdiction
In any case, the relations between the customer and riAuto Hauri are subject to Swiss law according to the provisions of the Swiss Code of Obligations (OR) and the Swiss Civil Code (ZGB), excluding the UN Convention on Contracts for the International Sale of Goods (CISG). CH-6403 Küssnacht am Rigi is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship.
